Terms Of Service

1. Warranty for Fencing and Decks

  • 1.1 Warranty Period: This warranty covers the installation of new wood fence and decks l provided by Black Swan Landscaping for a period of 1 ( one ) years from the date of completion.
  • 1.2 Scope of Warranty: Black Swan Landscaping warrants that the wood fence and deckswill be free from defects in workmanship during the warranty period. Labour to repair or replace the defective components of the fence or deck for a period of 1(one) year from installation.
  • 1.3 Warranty Claims: In the event of any issues or defects arising during the warranty period, the customer is required to promptly notify Black Swan Landscaping in writing or by contacting our customer service department at 647-271-8275 or [email protected]
  • 1.4 Remedy: Black Swan Landscaping will, at its sole discretion, repair or replace any components or address issues related to the installation that are found to be defective during the warranty period.
  • 1.5 Exclusions: This warranty does not cover issues caused by:
    • Damage resulting from accidents, misuse, or negligence
    • Wood cracking, discolouring or shrinking
    • Unauthorized modifications or repairs or construction
    • Acts of nature, including but not limited to, lightning, floods, or other natural disasters
  • 1.6 Limitation of Liability: Black Swan Landscaping shall not be liable for any consequential or incidental damages arising from the installation of the new deck or fences. Repaired fences and decks have only 30-day warranty. No warranty of work will be completed until all balances are paid in full.
  • 1.7 Governing Law: This warranty is governed by the laws of Ontario, Canada. Any disputes arising under or in connection with this warranty shall be subject to the exclusive jurisdiction of the courts in Ontario Canada.
2. Warranty for Lawn Sprinkler & Landscape Lighting System Installation
  • 2.1 Warranty Period: This warranty covers the lawn sprinkler system installation services provided by Black Swan Landscaping for a period of 5 ( five) years from the date of completion.
  • 2.2 Scope of Warranty: Black Swan Landscaping warrants that the lawn sprinkler & lighting system installation will be free from defects in workmanship during the warranty period. Labour to repair or replace the defective components of the sprinkler system is covered for a period of 5 (five) years from installation. This warranty includes all system components installed by Black Swan Landscaping, including the controller, valves, sprinkler heads, pipe, and backflow device, lighting fixtures.

    Yearly Spring and Fall Service must be completed by Black Swan Landscaping for the term of the warranty to be valid for lawn sprinklers.

  • 2.3 Warranty Claims: In the event of any issues or defects arising during the warranty period, the customer is required to promptly notify Black Swan Landscaping in writing or by contacting our customer service department at 647-271-8275 or [email protected]
  • 2.4 Remedy: Black Swan Landscaping will, at its sole discretion, repair or replace any components or address issues related to the installation that are found to be defective during the warranty period. If the part is no longer available, we will replace with a similar item.
  • 2.5 Exclusions: This warranty does not cover issues caused by:
    • Damage resulting from accidents, misuse, or negligence and wear and tear.
    • Unauthorized modifications, repairs or construction
    • Acts of nature, including but not limited to, lightning, floods, or other natural disasters.
  • 2.6 Limitation of Liability: Black Swan Landscaping shall not be liable for any consequential or incidental damages arising from the installation or use of the lawn sprinkler & landscape lighting system.
  • 2.7 Governing Law: This warranty is governed by the laws of Ontario, Canada. Any disputes arising under or in connection with this warranty shall be subject to the exclusive jurisdiction of the courts in Ontario Canada.
  • 2.8 Expiration of Warranty: This warranty expires 5 years from the date of completion of the lawn sprinkler & landscape lighting system installation.

    By accepting the lawn sprinkler system installation services provided by Black Swan Landscaping, the customer acknowledges and agrees to the terms and conditions of this warranty.
